These terms and conditions outline the rules and regulations for the use of Unique Fireworks & Special Effects’s Website, located at www.uniquefireworks.com.au.

By accessing this website we assume you accept these terms and conditions. Do not continue to use Unique Fireworks & Special Effects if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Netherlands. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amen these terms and conditions and it’s linking policy at any time. Removal of links from our website

If you find any link on our Website that is offensive for any reason, you are free to contact and inform us any moment. We will consider requests to remove links but we are not obligated to or so or to respond to you directly.

As long as the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.

Payment

Indoor Wedding Fireworks/Wedding Departure Fireworks: A deposit of $100 is required with the balance no later than 7 days before your reception date. For quotes of over $1500.00, 20% deposit is required.

If payment is not received by the due date, your booking will be cancelled and deposit forfeited. Once deposit payment is received your show date will be recorded into our system.

Receipt of a deposit constitutes a confirmation of your booking and is bound to the following Terms & Conditions

If booking for indoor wedding fireworks within 14 days of your show date, then full payment is required upon booking upon client receiving invoice.

 

Sound & Lighting: A deposit of $100 is required for us to reserve the date for you. For quotes more than $1500.00 20% deposit is required. The final balance must be paid at least 7 days prior to the event unless stated/agreed other wise by us. If we do not receive the payment before the event date the service(s) or product(s) booked will be cancelled. We reserve the right to cancel any booking(s) should the payment not be cleared on the due date.

 

Cancellation Policy:

Deposits are NOT refundable under ANY circumstances.

 

Cancellation by client:

Cancellation fee

Any cancellation less than 14 days of your booking date your deposit payment is non refundable.

 

If full payment has not been received by the due date, your booking will be cancelled and deposit forfeited.

 

If a show/booking is cancelled last minute on the day, you will be invoiced the FULL amount.

 

Adverse weather conditions:

 

Rain/Wind – Outdoor displays

If the display cannot proceed, we retain just $500.00 to cover our costs – site inspections, preparing fireworks (then undoing the work),

Advertisements, letterbox drops (unless this has been a significant dollar value…we will advise on booking). Many companies retain up to 50% or more of the total show value!

 

Total Fire Ban – Outdoor displays

If a total fire ban is declared by the CFA, firework displays generally do NOT get an exemption.

Exemptions usually only apply to major events such as NYE etc. when conditions are acceptable to the CFA.

 

The CFA has the FINAL decision with regard to firework displays on days of Total Fire Ban.

A Professional Fireworks Display can go ahead in most weather conditions, even conditions under which the general public would not expect a fireworks display, so don’t let this overly concern you. Where an amicable decision cannot be reached, then the UFW Display Supervisor allocated to your show will have sole responsibility for making the decision.

Again, if a total fire ban is declared and the display cannot proceed, we retain just $500.00 to cover our costs – site inspections, preparing Fireworks (then undoing the work), Advertisements, letter box drops (unless this has been a significant dollar value…we will advise on booking). Many companies retain up to 50% or more of the total show value.

 

Indoor Displays:

UFW is NOT responsible for the unlikely situation of a:-

  1. Malfunctioned product(s)
  2. Manufacturer(s) faulty product(s)
  3. And or any accidents that occur or caused by the neglect of the your guess that are out of our control.

Our company takes great measures to ensure your safety and the safety of our staff is not in jeopardized.

All displays must follow strict safety guidelines, however, there are things that happen and are out of our control, we will not be held accountable for those situation.

General:

If a display is cancelled or suspended by the client on arrival or after site set up it will be considered to be presented and will be payable in full.

 Insurance:

UFW maintains $20,000,000 Public Liability Insurance.

Ingress/Egress:

UFW require that all gates/boom-gates/barriers be unlocked and opened on the night of the display for

ingress/egress of our vehicles and/or crew. All roads/tracks must be navigable to the display site by van/car.

If on arrival gates are locked, UFW Display Supervisor will call the relevant person nominated as our contact on the night to arrange entry. UFW Fireworks personnel are under strict instructions to remain with our vehicles. It is up to the organizer to arrange unlocking of all gates/barriers.

Barriers/gates must be kept unlocked until after all crew have departed.

UFW display operator will phone the nominated person to advise we are leaving the display site.

Due to failure to provide access at our nominated times, crew will set up product as time allows, using our Safe

Working Conditions Policy. Show will be fired as setup, no refund or compensation will be given to client.

 

Notifying the relevant Authorities / Neighbours – outdoor displays only:

UFW undertakes notification to relevant authorities. WorkSafe requires all outdoor display to be notified to all local residents within a 100m radius of the display location, this is the responsibility of the event organiser (you). The cost of this notification is NOT included in your show cost.

UFW do not take any responsibility for any distress caused to local residents or livestock as a direct result of one of the displays.

 Site Security:

It is the responsibility of the event organizer to make sure that adequate safety measures are put in place. Security must be maintained until our departure. This includes firing site perimeter security, stopping the public from venturing into the firing site during setup or firing. The Display Team Lead has, at any time during the show, the power to stop the show, should the safety of the public and / or the firing crew be compromised. The client is responsible for monitoring the behavior of all patrons at the venue. No refund will be given if the show has to be stopped for security reasons.

 Promotion

From time to time UFW may take photos/videos of various displays/events for promotional purposes.

Should you not wish your event filmed please advice us accordingly.

 Confetti

UFW does not clean up any type of confetti discharged.

 Firing Site Cleanup

It is inevitable that following a show, the firing site used will contain debris from the display itself. Whilst we always perform a thorough clear up following a show it is very likely there will be some debris remaining. The debris from a fireworks display will only normally be small pieces of paper, small cardboard discs and small pieces of foil (should rain protection be required). This is the same for each and every show, and with each and every other Fireworks Display Company. The cardboard/paper is biodegradable and, if concerned, can easily be dispersed by mowing. If, however you should require a complete and full 100% cleanup, then please notify us in plenty of time so this can be arranged by us having more crew, and additional equipment and we will advise of the fee.

Sound/Karaoke Lighting Hire

All given quotes are inclusive of our setup, tear down and delivery fees unless agreed other wise by UFW and the client(s).

UFW will not be responsible or liable in any way, form or manner whatsoever –

  1. Accidents that occur to the client(s) such as yourself or your guest(s) that was not cause by us or our equipment but by the individual.
  2. In the unlikely case of a power interruption causing the sound system to shut down therefore interrupting the ceremony.
  3. Injuries to you or your guest(s) as a result of too much alcohol consumption, and therefore tripping over our equipment leading to injuries.

You as the hirer is deemed to be responsible for any damaged caused to our equipment by you or your guest(s) as a result of negligence due to too much alcohol consumption. Fees/charges will apply to cover the cost of the damages caused. The amount will be charge accordingly at our discretion.

Exclusion/Disclaimer

UFW will not be held responsible or liable in any way, form or manner whatsoever:-

  1. As a result of any third party cleaning fees prior to or after the fireworks/pyrotechnics event, including but not limited to confetti, snow, bubble and foam effects.
  2. As a result of any unforeseen and/or any unauthorized human intervention;
  3. As a result of any unforeseen natural disasters or so called Acts of God;
  4. If an appropriate zone on a Fire Indicator Panel has been isolated and a fire breaks out within the building that results in the Metropolitan Fire Service or any other Emergency Service not being called out;
  5. For false alarms on a Fire Indicator Panel and any cost arising due to the Metropolitan Fire Service or any other Emergency Service being called out.
